Wake County Divorce Records

The Family Law section of the Circuit Court presides over divorce matters, in which two people decide to legally terminate their marriage. The records generated during the process are maintained by the Clerk of Superior Court and can be requested from that office. The most important document is the divorce decree, which confers legal validity on the parties' post-marital status. Others involve agreements or settlements pertaining to how joint property is distributed, alimony payments, or custody arrangements.

North Carolina's legal system treats almost everything in a divorce file as public by default, with specific exemptions carved out by confidentiality laws regarding juveniles, domestic violence, financial details, medical records, and sensitive identifiers.
